By accessing, signing into, or using Loanwright ("the Service"), operated by Mortgage Innovations LLC ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"), including the disclaimers, limitations of liability, and assumption of risk provisions contained herein. If you do not agree, do not use the Service.
You acknowledge that the Service is an organizational and workflow tool and that you assume full responsibility for any decisions, actions, or submissions you make in reliance on or in connection with the Service, its checklists, or its outputs.
Loanwright provides file readiness checklists, guideline intelligence, and workflow tools for mortgage brokerages. The Service is provided on an "as is" basis.
LOANWRIGHT IS AN ORGANIZATIONAL TOOL AND IS NOT A SUBSTITUTE FOR PROFESSIONAL LEGAL, COMPLIANCE, REGULATORY, OR FINANCIAL ADVICE.
Checklists, guideline answers, and readiness assessments are generated algorithmically and may be incomplete, inaccurate, or out of date. They do not constitute legal opinions, compliance certifications, or guarantees that a loan file meets any particular lender, investor, or agency requirement. You are solely responsible for verifying the completeness and accuracy of your loan files, and for obtaining appropriate professional advice, before submission to any lender, investor, or government agency.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account. You must be at least 18 years of age to use the Service.
You agree not to: (a) misuse the Service; (b) attempt to access other users' data; (c) reverse-engineer, decompile, or disassemble the platform; (d) use the Service for any unlawful purpose; (e) upload malicious files or content; or (f) circumvent usage limits or security measures.
The Service offers a free tier and paid subscription plans. Paid subscriptions are billed monthly via Stripe. By subscribing, you authorize recurring charges to your payment method. You may cancel at any time through your account settings or the Stripe billing portal; cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months. We reserve the right to change pricing with 30 days' notice to active subscribers.
The Service, including its design, code, algorithms, and documentation, is owned by Mortgage Innovations LLC and protected by intellectual property laws. You retain ownership of any data you upload. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell or rent your personal information or loan file data.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CHECKLISTS, GUIDELINE ANSWERS, OR OTHER OUTPUTS GENERATED BY THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MORTGAGE INNOVATIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS YOU HAVE ACTUALLY PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Mortgage Innovations LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period for backup and audit purposes.
These Terms are governed by the laws of the State of Utah, without regard to conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah. You waive any objection to jurisdiction and venue in such courts.
We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
